Both entities jointly operate the PlatiniumHost.com platform and act as joint controllers for the processing of their clients' personal data, in accordance with applicable laws in Venezuela and the United States.
2. Applicable Legal Framework
Venezuela: This Policy is governed by the Special Law Against Cybercrimes (LECDI), the Infogovernment Law, the Organic Law on Telecommunications (LOTEL), and the general principles of the Venezuelan Civil Code concerning confidentiality and data protection.
United States: We comply with the California Consumer Privacy Act (CCPA/CPRA), the Florida Information Protection Act (FIPA), the Computer Fraud and Abuse Act (CFAA), the CAN-SPAM Act, and the regulations of the FTC (Federal Trade Commission).
International: We adopt the principles of the EU General Data Protection Regulation (GDPR) as an international benchmark, applying them to all our users regardless of their location.
3. Personal Data We Collect
Identification and Contact Information: full name, company name, Tax ID (RIF/NIF/EIN), mailing address, phone number, email address, and client portal access credentials (my.platiniumhost.com).
Billing Information: Details required for the issuance of invoices and receipts. PlatiniumHost DOES NOT store credit card numbers, bank accounts, or digital wallet credentials. All transactions are processed by PCI-DSS certified payment gateways.
Technical data: IP address, browser type, operating system, pages visited, session duration, and functional cookies. Exclusively used for security, DDoS mitigation, and performance enhancement.
Communications data: support ticket records, chat logs, and emails, retained for a maximum of 5 years for audit and quality purposes.
4. Purpose of Data Processing
Service Delivery: Contract management for hosting, domains, VPS, dedicated servers, reseller accounts, and associated services; billing and collections; critical technical notifications; Level 3 technical support.
Legal Compliance: Responding to requests from Venezuelan or U.S. authorities, provided there is a binding and duly verified legal mandate. We will not disclose information without a formal court order.
Service improvement: aggregated and anonymous statistical analysis of platform usage; detection and and prevention of fraud, abuse, and illicit activities; maintenance of network security.
Business Communications: Notifications regarding expirations, renewals, and promotions. Users may unsubscribe from these communications through their control panel or by sending an email to my.platiniumhost.com/submitticket.
5. Data Protection Principles
Legality and Transparency: Data processed on a legitimate legal basis and with full transparency to the data subject. Purpose Limitation: Data collected for specific, explicit, and legitimate purposes, without incompatible further processing.
Data Minimization: We collect only the data strictly necessary for service provision. Accuracy: We maintain up-to-date data and rectify or erase inaccurate data.
Data Retention: Data is retained for the necessary period, not exceeding 7 years for billing (fiscal requirement) and 5 years for support. Integrity and Confidentiality: Appropriate technical and organizational measures are in place, including TLS/SSL encryption and periodic audits.
6. Data Sharing with Third Parties
PlatiniumHost does not sell, rent, transfer, or commercialize the personal data of its users under any circumstances.
We share data with providers acting as data processors: payment processors (e.g., PayPal, Stripe, bank gateways) under confidentiality agreements; infrastructure providers in data centers located in Miami, FL; Los Angeles, CA; New York, NY; and Buffalo, NY; and web analytics tools with IP anonymization configured.
Legal Disclosure: We will only disclose personal information pursuant to a valid court order or a formal request from competent Venezuelan authorities (CONATEL, SUSCERTE, Public Ministry) or U.S. authorities (FBI, FTC, Florida or California authorities), following verification of its legitimacy.
7. Rights of the Data Subject
All users have the right to: Access (to know what data we hold), Rectification (to correct inaccurate data), Erasure (to delete data when it is no longer necessary), Restriction of Processing, Data Portability (to receive data in a structured format), and Object to processing for direct marketing.

8. Data Security
We have implemented enterprise security measures: SSL/TLS encryption across all communications; perimeter firewalls and IDS/IPS systems; RBAC access control with multi-factor authentication for technical staff; daily automated backups with a 30-day retention period; and continuous 24/7 monitoring.
In the event of a security breach, we will notify affected users within a maximum of 72 hours from detection, in accordance with GDPR and the laws of Florida and California.
9. Cookies and Tracking Technologies
We use strictly necessary cookies for the operation of the website (session authentication, language preferences, service cart). These cannot be disabled without affecting basic functionality.
